1. Acceptance of Terms

By accessing or using the Pupstin application, website, or services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

2. Account Registration

To use Pupstin, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account by not sharing your OTP or login credentials
• Accept responsibility for all activities that occur under your account
• Be at least 18 years old to create an account

You are responsible for safeguarding the password or credentials you use to access the Service. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

3. Pet Profiles and Content

When creating pet profiles and posting content, you agree to:

• Only upload photos of pets you own or have permission to represent
• Provide accurate information about your pet's age, breed, and vaccination status
• Not upload inappropriate, misleading, offensive, or harmful content
• Not use Pupstin for breeding, commercial, or illegal purposes without explicit permission
• Respect the privacy and rights of other users

We reserve the right to remove any content that violates these Terms or is otherwise objectionable in our sole discretion.

4. Subscription Plans and Payments

Pupstin offers both free and premium subscription plans:

• Free Plan: Includes limited swipes (5 per day) and basic chat functionality.
• Premium Plan: Includes unlimited swipes, unlimited chat, highlighted pet profiles, and the ability to see who liked your pet.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
• Payment will be charged to your account upon confirmation of purchase.
• Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.
• All fees are exclusive of applicable taxes, which will be added to your payment.

5. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any unlawful purpose or in violation of any local, state, national, or international law
• Harassing, abusing, threatening, or intimidating other users
• Impersonating any person or entity or falsely stating your affiliation with a person or entity
• Uploading viruses, malware, or other malicious code
• Attempting to gain unauthorized access to our systems or other users' accounts
• Using the service to arrange meetings for purposes other than pet socialization
• Collecting or harvesting any information from the Service
• Interfering with or disrupting the Service or servers connected to the Service

6. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Pupstin and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from Pupstin.

7. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by deleting it through the app settings or by contacting us.

8. Limitation of Liability

To the maximum extent permitted by law, Pupstin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

We do not guarantee that the Service will be uninterrupted, secure, or error-free. The Service is provided "as is" and "as available" without warranties of any kind.

9. Indemnification

You agree to defend, indemnify, and hold harmless Pupstin and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, resulting from or arising out of:

• Your use of and access to the Service
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your content caused damage to a third party

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in San Francisco County, California.
